Required Documents for Registering a Živnostenský List
In order to be able to apply, normally the following documents are needed:EU-citizen, registered here longer than 3 months:
- NO extract of the criminal record needed
- recommended: proof of the last address abroad
EU-citizen, registered here shorter than 3 months:
- an extract of the criminal record abroad, no apostille needed (but recommended)
- recommended: proof of the last address abroad
3rd-Country Nationals:
- an extract of the criminal record abroad, WITH apostille *
- proof of the last address abroad
US citizens may sign an afidavit at the Prague US embassy instead, costs around 700 CZK
For all nationalities:
- a passport + 2 copies with signature in blue,
- a rental contract for the residence address in CZ, or a copy of the passport with the residence address in CZ
- agreement of the building owner for registering your trade license there,
- OR a contract for a business-seat at a virtual office,
- OR for home-owners, the purchase contract of the CZ address
NOTE : All foreign documents need to be translated and must not be older than 3 months.
Choosing a Živnostenský List type:
Next you will choose a / the trade license(s) that best fits your business activities (there are about 80 to choose from). If those activities fall into "Výroba, obchod a služby neuvedené v príloháh 1 až 3 živnostenského zákona" you do not have to show any specifications or diplomas. Exceptions are for example money- or medical-related professions.After that, we will register your tradelicence. We will go with you to register, this takes less than 1 hour.
Then after 3-5 days we can pick up your živnostenský list or the proof that you are entitled to get one (it is necessary for the Visa application).
3rd-Country Nationals without a Permanent or EU Residence Permit must register at the Commercial Court before they can get their trade license activated.
Registration at the Commercial Court
For 3rd-Country Nationals with a D Visa there is still the obligation to register at the Commercial Court within 3 months of getting the trade license. Until that time you are not allowed to trade. Only after registration at Commercial Court you can register at the Tax office and Social Office, because the Commercial Court will give you an ICO which is needed for further registrations and sending invoices.This registration is a lot more complicated than registration at the trade license register, and also much more expensive. Just the stamp duty alone is 5.000 CZK, and registration needs to be repeated every time your visa needs to be extended!
Registration at the Taxoffice / Social- and Health Insurance
After the trade license registration is complete, it must be registered at the tax office, the social office and health insurance, since you are now self-employed and obligated to social- and health charges on monthly basis.*3rd-Country Nationals with a Visa or temporary Residence Permit do not have to pay the monthly health charges (because they already paid for health insurance for the duration of their stay).
US-citizens that are self-employed in the US and bring a statement from social security from the US, stating that they will pay social charges in the US, do not even pay social charges. However, this does not mean they should not be registered at the social office here. The Czech social office needs to issue a confirmation, without it social charges anyway need to be paid.

Pricing for Registration at the Trade license Register and Commercial Court
(For 3rd-Country Nationals with a D- Visa)
For most 3rd-Country Nationals there is an obligation to register the the Commercial Court within 3 months of getting the trade license. Until this time you are not allowed to trade. This registration is a lot more complicated than registration at the trade license register, and also much more expensive. The price for trade license registration and commercial court registration is 6.500 - 9.500 CZK*
Including all necessary CZ documents, including registrations for tax / social / health
Excluding trade license register stamp duty (1.000 CZK), commercial court stamp duty (5.000 CZK),
excluding Visa application work, excluding translation costs (from 500 CZK / page).
We charge 795 CZK / hour extra in case your application is more work
(because of unforeseen problems, missing documents, etc.)
Applying for a Business Visa for 3rd-Country Nationals
3rd-Country Nationals who have a trade license or an s.r.o. company, do not need Work Permit. They need to apply for a Visa for Business purposes, on basis of the trade license. In case they have already a visa with another purpose of stay then most likely the purpose of stay needs to be changed to business.If you have already a D-Visa for employment purposes, then it is possible to change the purpose of stay into 'Business', provided that there is more than 3 months left on the original visa and you comply to all the requirements of the Business Visa. For this, it is not necessary to go abroad. This can be done at the Foreign Police in Prague.
